Pennsylvania Court Upholds Compressor Station

The Pennsylvania Commonwealth Court has ruled that a compressor station is part of the production process and can’t be banned in townships where gas wells are permitted.

As Marcellus Shale gas production has spread, some Pennsylvania, U.S.A., towns have sought to regulate encroaching wells and pipelines.

The McKean County court had upheld a Bradford Township Zoning Hearing Board ruling that the township’s ordinances prohibited a proposed New Century Pipeline compressor station, although they allowed oil and gas production.

However, the appeals court said that because the compression station was required to move gas from the wellhead to the pipeline, it was an essential part of the production process.

Commonwealth Court Judge Mary Hannah Leavitt said, “The evidence is uncontroverted that without the compressor station, New Century’s gas at the wellhead is useless, except, perhaps, for flaring and roasting marshmallows.”
